(ii) Minimum cost.--The Secretary shall approve projects to the extent that the costs of the projects are at least 2 percent below the Secretary's estimate for non-Federal share projects. (D) Waiver.--The Secretary, in selecting to carry out a project under this section, may waive all or part of the requirement that such project incorporate the use of certain projects, including small public transportation projects, projects to increase access, or projects to increase capacity of existing public transportation systems. The Secretary shall carry out projects authorized under this paragraph in consultation with the local governments within a corridor.
